Condition ignored in one automation

And I trigger with this button:

        tap_action:
          action: call-service
          service: automation.trigger
          service_data:
            entity_id: automation.porton_test
        type: entity-button

I want that only when I´m home the automation make that mqtt publish, but in this moment this don´t happend, it no matters were I´m it always make the mqtt publish.
